Falls on public walk ways or public establishments:

POOR CONDITION OF WALKWAYS, THE MAIN REASON FOR TRIPS AND FALLS

When someone suffers a fall on the street and suffers any form of injury, however minor it may be, they are normally upset and in no condition to move. They must bear in mind that in order to claim the corresponding compensation, they must

  • Call the police at the time of the accident so that they can carry out the necessary report, take photos of the damages and what caused the accident. If you cannot do it yourself, it would be convenient to ask someone to do it for you.
  • Find witnesses: it´s important that if there are witnesses, that they figure in the report and give their declaration to the police that deals with the accident, as their declaration will be vital in a possible Trial. If this is not possible at the time, at least take their personal details in order for them to be summoned for trial.
  • They must attend the A&E room the same day as the accident. All injuries must be stated on the emergency medical report. And if the injuries require work leave, then the victim must attend the GP Doctor to obtain the necessary slip, in order to submit also said work leave and discharge reports of the National Health System, as well as the reports of surgical interventions, medical consultations, medical treatment, rehabilitation, etc.

Our Judicial Order states, for a wide range of different cases, the extra-contractual Civil Liability Principle, for which if a person or Business, due to actions of neglect, negligence or serious imprudence, causes harm to a person´s wellbeing or estate, said victim would have the right to repair or economical compensation for said harm.

A very particular kind of fall in this field, are those which occur in public establishments or commercial centres. These are the cases in which, due to poor state of the floor (missing tiles, puddles or slippery surfaces), clients can suffer injuries due to slips and falls.
